What changes from state to state

Federal law sets a floor: a $7.25 minimum wage, overtime after 40 hours in a workweek and up to 12 weeks of unpaid, job-protected family leave for eligible employees. States can add to it, and many do, so the same job can come with different pay and protections depending on where you live.

How current are the figures?

We checked each figure against the state’s own website in October 2026 and give the year it applies to. Wages and programs change, so check the linked official page before you rely on a number.

Which states pay family leave benefits?

Of the 20 states with a guide here, California, New York, New Jersey, Washington, Massachusetts and Colorado pay benefits now. Maryland’s program starts paying on January 1, 2028, and Virginia’s by December 1, 2028.
