Virginia passed major new laws in 2026: pay ranges in every job ad, a rising minimum wage, and paid sick leave and family leave on the way.
Pay in Virginia
Virginia’s minimum wage is $12.77 an hour in 2026. Laws passed in 2026 raise it to $13.75 on January 1, 2027 and $15.00 on January 1, 2028, with yearly inflation increases from 2029, as the Department of Labor and Industry confirms and the Code of Virginia.
Since July 1, 2026, Virginia employers have had to put a pay range on every job ad, and they can no longer ask applicants what they earned before.

Paid sick leave
Today Virginia’s paid sick leave law covers only home health workers. A 2026 law extends it in stages: from July 1, 2027 for employers with 50 or more employees, January 1, 2028 for 25 or more, and January 1, 2029 for all employers. You will earn 1 hour for every 30 hours worked, up to 40 hours a year, and can use it to care for your child.
Paid family and medical leave
Virginia enacted a paid family and medical leave insurance program in 2026, run by the Virginia Employment Commission. Contributions begin by April 1, 2028, and the Commission must start paying benefits by December 1, 2028.
Help with child care
The Child Care Subsidy Program, run by the Virginia Department of Education with local departments of social services, helps pay for child care. You can apply online through CommonHelp or on paper at your local department of social services. Many localities have had waiting lists since July 1, 2024. Families below the poverty level pay $5 a month, and others pay up to 5 percent of income.
The Virginia Preschool Initiative funds preschool for at-risk 3-year-olds and 4-year-olds, including families at or below 200 percent of the poverty level. Full-day programs give at least 5.5 hours of instruction a day. Enroll through your school division.
Tax credits
Virginia’s earned income credit is 20 percent of your federal credit and refundable for tax years 2025 and 2026. A nonrefundable version and the Credit for Low-Income Individuals are alternatives.
